No merchant, merchant affiliate or other person or entity may use any TCH trademarks, tradenames or other intellectual property in any advertising, publicity releases, promotional materials, publicly filed or distributed documents, website, or in any other manner, without first securing the prior written consent of TCH, in each instance in a case by case basis, which consent may be withheld in the sole discretion of TCH.
